Who’s Next?

It’s no secret to our regular readers that transforming the federal judiciary to read the Constitution as the founders intended is near and dear to the heart of this blog. One of our favorite blogs, Confirm Them, is frequented by many folks who share the originalist vision of our governing documents. Notably, it is also frequented by many who run in conservative legal circles in D.C. Many of these folks are either federal clerks themselves or know clerks of current Justices. Rumors are already swirling of another near-term vacancy. Is it David Souter, who once confided that he wanted to return to his native New Hampshire at age 65? Is it Justice Ginsberg whose health (and that of her husband) has been suffering for several years? Or perhaps Justice Stevens who, while still vigorous, is on the short end of the actuarial tables (and who, despite his liberal jurisprudence, still considers himself a Republican)? Many are saying we’ll find out sooner rather than later. In the interim, this post is a great place to go to see what conservative legal types are saying about the ”farm team” originalists now have to choose from in choosing the 111th Supreme Court Justice.
